Terms of Service

1. Agreement to These Terms

These Terms of Service ("Terms") are an agreement between you and SKK Ventures LLC, doing business as FeisScore ("FeisScore," "we," "us," or "our"). They govern your access to and use of FeisScore, including feisscore.net and the features, content, subscriptions, scoring, feedback, community, studio, parent, and related services we provide (collectively, the "Services").

By creating an account, purchasing a subscription, clicking an agreement checkbox where one is presented, or otherwise using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

If you use FeisScore on behalf of a child or another person, you represent that you have authority to do so and to agree to these Terms on their behalf where permitted by law.

2. Eligibility and Minors

Users must be at least 13 years old to independently manage a FeisScore dancer account.

A dancer under 13 may use FeisScore only after the required parent or legal guardian approval flow is completed. FeisScore asks the dancer for a parent or guardian email and sends a secure approval link. A parent or guardian does not need to create a FeisScore account solely to submit this approval. Until approval is completed, the under-13 dancer cannot use protected features such as scoring, text AI Coach, or Live AI Coach. The separate Parent Portal remains an optional account feature.

FeisScore may restrict features, request additional parent or guardian information, or suspend access where reasonably necessary to satisfy age, safety, privacy, or legal requirements.

Nothing in these Terms limits rights or protections that apply to children or parents under applicable law.

3. What FeisScore Provides

FeisScore is an AI-powered Irish dance training, scoring, and feedback platform. The Services may include performance analysis, scores, technique feedback, progress tracking, training recommendations, Feis Prep features, community features, parent tools, studio tools, and other training-related features.

Features may vary by account type, subscription, location, device, or availability.

4. AI Scoring and Feedback Disclaimer

FeisScore uses artificial intelligence and related technology to analyze dance performances and generate scores, feedback, and recommendations. FeisScore also offers an AI Coach, including a text coach and an optional Live AI Coach that uses microphone/voice interaction and an AI avatar.

FeisScore scores and AI-generated feedback are provided for training, practice, and informational purposes only.

They are not official adjudication, competition results, championship qualification, placement decisions, or guarantees of future performance.

AI systems can make mistakes. Scores and feedback may be incomplete, inaccurate, inconsistent, or different from the opinion of a human adjudicator or teacher.

FeisScore is not affiliated with or endorsed by any Irish dance governing body or adjudication organization unless FeisScore expressly states otherwise.

You must not represent a FeisScore score as an official competition score or official adjudication result.

5. Training, Exercise, and Safety Disclaimer

FeisScore may provide technique suggestions, drills, stretch recommendations, strength recommendations, training plans, or other physical-performance suggestions.

These features are educational training tools and are not medical advice, physical therapy, injury diagnosis, or a substitute for a qualified Irish dance teacher, physician, physical therapist, or other appropriate professional.

Users are responsible for determining whether an activity is appropriate for them. Stop an activity if it causes pain or appears unsafe and seek appropriate professional guidance where needed.

FeisScore does not guarantee that use of its training recommendations will prevent injury or improve competition results.

6. Accounts and Account Security

You agree to provide accurate information and keep your account information reasonably current.

You are responsible for protecting your login credentials and for activity occurring through your account.

You may not impersonate another person, create an account using information you are not authorized to use, or knowingly provide false age, identity, subscription, or account information.

Contact FeisScore promptly if you believe an account has been accessed without authorization.

7. User Content and Dance Videos

You retain ownership of content you submit to FeisScore, subject to the limited rights needed for us to operate the Services.

You represent that you own your submitted content or have the rights and permissions necessary to submit and process it.

By submitting content, you grant FeisScore a limited, non-exclusive license to host, store, transmit, process, analyze, reproduce as technically necessary, moderate, and display that content as reasonably necessary to provide, secure, support, and operate the Services.

Dance videos are private by default. FeisScore may provide features allowing you to intentionally share scores, profiles, showcase content, or videos with other users or through external services. Content you choose to share may be viewed, copied, or reshared by the audience to whom you make it available.

If you separately enable an optional setting allowing eligible content to be used for AI improvement, FeisScore may process eligible content for that purpose as described in the Privacy Policy and the applicable setting.

You may not upload content that is illegal, infringes another person's rights, violates privacy rights, or that you do not have permission to submit.

8. Video Retention and Deletion

Video retention depends on the user's plan, account settings, and the retention options available at the time of submission.

Non-paid submissions are currently assigned a 90-day video expiration period.

Certain paid accounts may have additional video-retention choices shown in FeisScore settings. Retention choices generally apply to future submissions unless FeisScore states otherwise.

When a video expires or becomes unavailable, associated scores, feedback, and submission records may remain in the account.

Deleting a submission or account may remove content from normal use of the Services, but limited residual copies may remain temporarily in backups, service-provider systems, fraud-prevention records, or other records FeisScore is permitted or required to retain, as described in the Privacy Policy.

9. Subscriptions, Billing, and Automatic Renewal

FeisScore offers free and paid plans. Current plan features, limits, and pricing are displayed in FeisScore or during checkout.

Unless otherwise stated during checkout, paid FeisScore plans are recurring monthly subscriptions.

Paid subscriptions automatically renew until canceled.

Payments are processed through Stripe. FeisScore does not directly store full payment-card information.

You authorize the applicable recurring subscription charges when you purchase a paid subscription.

If a payment fails, FeisScore may restrict paid features or change the subscription status until payment is resolved.

FeisScore may change plan pricing or features prospectively. Where required by applicable law, we will provide appropriate notice before a change affecting an existing recurring subscription takes effect.

10. Cancellation and Refunds

Users with an eligible paid subscription may cancel through the cancellation option provided in FeisScore settings.

Under the current cancellation flow, cancellation takes effect at the end of the current paid billing period. Paid access remains available through that period, after which the account generally returns to the applicable free plan.

Cancellation does not automatically create a refund for charges already paid.

Refund or billing-dispute requests may be reviewed individually by FeisScore. Refunds will be provided where required by applicable law or where FeisScore otherwise approves a refund.

11. Plan Limits and Service Usage

Different FeisScore plans may include different submission limits, features, storage options, studio limits, parent features, or other usage allowances.

Current limits shown within FeisScore are part of the applicable plan offering.

You may not bypass, manipulate, falsify, or interfere with subscription limits, scoring-credit limits, usage counters, billing controls, or access restrictions.

FeisScore may correct account or usage records when reasonably necessary to address errors, fraud, duplicate processing, or technical failures.

12. Community and Shared Features

Users of community and shared features must behave respectfully and safely.

You may not use FeisScore to:

• bully, threaten, harass, stalk, or abuse another person;
• post hateful, sexually explicit, exploitative, or otherwise inappropriate content;
• expose another person's private contact information or personal information without permission;
• spam, scam, impersonate, or engage in deceptive promotion;
• encourage unsafe interactions with minors;
• post illegal content;
• infringe copyright, trademark, privacy, publicity, or other rights;
• distribute malware, malicious links, or harmful code.

FeisScore may use automated and human moderation, respond to user reports, remove content, limit features, suspend accounts, or take other reasonable safety actions.

13. Prohibited Uses and Security

You may not:

• attempt unauthorized access to FeisScore systems, accounts, databases, files, APIs, or administrative tools;
• probe, scan, exploit, attack, or interfere with FeisScore security;
• bypass authentication, authorization, rate limits, plan restrictions, or other technical safeguards;
• scrape or automatically extract data from FeisScore except where expressly permitted;
• reverse engineer or attempt to obtain proprietary source code except to the limited extent such restriction is prohibited by law;
• submit falsified or manipulated account, subscription, video, scoring, age, dance, or performance information for the purpose of defeating FeisScore safeguards;
• misuse FeisScore AI, scoring, community, billing, storage, or moderation systems;
• use the Services for unlawful activity.

We may investigate suspected misuse and take reasonable steps to protect FeisScore and its users.

14. FeisScore Intellectual Property

FeisScore and its software, branding, logos, interface, original content, scoring systems, scoring methodology, databases, design, and other proprietary materials are owned by or licensed to SKK Ventures LLC and are protected by applicable intellectual-property laws.

These Terms do not transfer ownership of FeisScore intellectual property to users.

You may use FeisScore scores, reports, and feedback generated for your account for personal training and ordinary personal sharing, but you may not falsely represent them as official adjudication results or use FeisScore branding in a way that implies endorsement, partnership, or affiliation without permission.

Third-party names, organizations, trademarks, and content remain the property of their respective owners.

15. Third-Party Services

FeisScore relies on third-party service providers, which may include Base44, Google Cloud AI / Gemini, Stripe, Sentry, hosting providers, and other technology providers.

Third-party services may have their own terms and policies.

FeisScore is not responsible for third-party outages, failures, changes, or conduct beyond FeisScore's reasonable control, except where applicable law provides otherwise.

16. Suspension and Termination

FeisScore may suspend, restrict, or terminate access when reasonably necessary because of:

• violation of these Terms;
• fraud, abuse, harassment, or unsafe conduct;
• security threats or unauthorized activity;
• nonpayment or failed payment;
• legal or regulatory requirements;
• misuse of FeisScore systems or intellectual property; or
• conduct that creates material risk to FeisScore, its users, or others.

Where appropriate, FeisScore may provide notice or an opportunity to resolve an issue, but immediate action may be taken for serious safety, security, fraud, or legal concerns.

Users may stop using FeisScore at any time. Subscription cancellation and account deletion are separate actions.

17. Service Availability and Changes

FeisScore is an evolving technology service.

We may update AI models, scoring versions, features, interfaces, limits, storage behavior, or other parts of the Services.

Scores generated under different scoring versions, AI models, or product versions may not be directly identical or comparable.

We do not guarantee that every feature will always be available, uninterrupted, error-free, or compatible with every device, browser, video format, or internet connection.

18. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FEISSCORE AND THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

WE DISCLAIM WARRANTIES NOT EXPRESSLY PROVIDED IN THESE TERMS, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT SUCH DISCLAIMERS ARE PERMITTED BY LAW.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SKK VENTURES LLC AND FEISSCORE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST OPPORTUNITIES, LOST COMPETITION RESULTS, OR LOSS OF DATA ARISING FROM OR RELATING TO THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF:

• (A) THE AMOUNT YOU PAID TO FEISSCORE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
• (B) US $100.

These limitations do not apply where applicable law does not permit them.

20. Privacy

Our Privacy Policy explains how FeisScore collects, uses, shares, protects, and retains personal information and describes applicable privacy rights and choices.

Use of FeisScore is also subject to the Privacy Policy.

21. Changes to These Terms

We may update these Terms from time to time.

When we update them, we will change the "Last updated" date.

If a change is material, we may provide additional notice where appropriate or required by law.

Your continued use of the Services after updated Terms become effective constitutes acceptance to the extent permitted by applicable law.

22. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

Failure by FeisScore to enforce a provision does not waive our right to enforce it later.

These Terms and the Privacy Policy constitute the agreement between you and FeisScore regarding the Services except where you and SKK Ventures LLC have entered into a separate written agreement covering a particular service.
